Virtual Assets Act Pakistan Sets Jail Terms But Enforcement Is Still Taking Shape

The Virtual Assets Act Pakistan passed by parliament in March 2026 is one of the toughest crypto laws in South Asia. It sets criminal penalties of up to PKR 50 million and five years in prison for anyone running a crypto business without a license. But several months after the law was signed, a key question hangs in the air: is Pakistan ready to actually enforce it?

What the Virtual Assets Act Pakistan Actually Says

The bill passed both the Senate and the National Assembly, turning PVARA into a permanent federal regulator with expanded oversight powers across the virtual asset industry. Before this, PVARA had been created by a presidential ordinance in July 2025, and without the new law that ordinance would have lapsed in early March 2026. So parliament acted just in time to keep the regulator alive.

The penalties in the law are serious. The law introduces criminal penalties for unlicensed operations, including fines of up to PKR 50 million (about $179,000) and imprisonment of up to five years. Unauthorized virtual asset offerings or promotional activities receive a separate penalty of up to PKR 25 million ($89,000) and three years imprisonment.

The penalties in the law target businesses, not ordinary users. So if you are a regular person buying Bitcoin on your phone, you are not the one facing jail time. The law goes after the companies and individuals who run platforms or promote unlicensed schemes.

What PVARA Can Do Under the New Law

PVARA, now a permanent autonomous body, gains broad authority to issue, suspend, or revoke licenses for crypto exchanges, custodians, wallet providers, token issuers, and other virtual asset service providers operating in or targeting Pakistan. It can set standards for investor protection, risk management, cybersecurity, and operational resilience. It also enforces AML and counter-terrorism financing compliance in line with FATF recommendations, coordinating with the State Bank of Pakistan, the SECP, and the Financial Monitoring Unit.

The law also lets PVARA designate special virtual asset zones to attract blockchain firms, though no zones have been designated yet. One additional requirement that most coverage skips: applicants must already be recognized in major jurisdictions such as the US, EU, or Singapore, alongside Shariah-compliance requirements overseen by a board of Islamic finance scholars. That is a high bar, and it explains why the process is moving slowly.

The Gap Nobody Talks About: No Exchange Is Fully Licensed Yet

Here is the detail that most headlines miss. The current status of the biggest global exchanges operating in Pakistan is: approved to start the process, not approved to fully operate. PVARA says the full licensing regulations are still being finalized, with a public consultation on the detailed rules running through mid-2026.

PVARA ran a public consultation from June 11 to July 2, 2026 on its draft Virtual Asset Services Regulations. The draft included a ten-category licensing framework for virtual asset service providers and an NOC-to-license pathway. The consultation window closed July 2, 2026, and a revised text is expected afterward.

In December 2025, major exchanges Binance and HTX received No Objection Certificates from PVARA. An NOC is not a full license. It means a firm can begin the registration process, not that it is cleared to operate freely. Until the final licensing rules are published and firms pass all checks, the Virtual Assets Act Pakistan technically applies to all of them.

The FIA Steps In: Pakistan’s New Crypto Crime Unit

The enforcement picture got clearer in late July 2026. A new unit sits within the FIA’s National Command and Control Centre, or NC3, and will investigate the suspected use of cryptocurrencies in money laundering, terrorism financing, and other crimes.

FIA Counter-Terrorism Wing Director Dr Muhammad Athar Waheed told local media outlet Dawn the unit investigates the use of crypto in crimes rather than regulating the market. Therefore, PVARA keeps sole authority over oversight. This means Pakistan now has a split structure: PVARA handles licensing and market supervision, while the FIA handles criminal investigations.

By assigning market regulation to PVARA and criminal enforcement to the FIA, Pakistan is establishing distinct responsibilities for supervising licensed businesses while investigating unlawful activity involving digital assets.

This is actually an important detail for Pakistan’s roughly 40 million crypto users, making it one of the largest emerging markets for digital assets. With the FIA now in play, enforcement of the Virtual Assets Act Pakistan has a real operational arm behind it, not just a regulator issuing notices.

The Shariah Wrinkle

There is one more complication that most international coverage glosses over. A fatwa from the Jamia Darul Uloom Karachi seminary contests the status of cryptocurrencies as wealth under Islamic law, complicating the government’s plans. To address this, licensed firms must submit their services to a committee of Islamic finance scholars for Shariah approval. This adds another layer to an already demanding licensing process and could slow things down further for firms trying to serve Pakistani retail users.

What This Means for Everyday Pakistani Crypto Users

If you already hold Bitcoin or other coins on a global exchange, the law does not come after you directly. The criminal provisions target the operators of unlicensed platforms. But there is a practical risk: if the exchange you use fails to get a full PVARA license, it could be forced to stop serving Pakistani customers or face action. That means your ability to trade or withdraw funds could be disrupted.

The smart move right now is to check whether the platform you use has received at least a No Objection Certificate from PVARA, and to watch for the final licensing rules that should come after the July 2026 consultation closes. The Virtual Assets Act Pakistan is now permanent law, and its teeth are getting sharper as each month passes.
