What the Apple OpenAI Trade Secrets Lawsuit Actually Says

Apple is suing OpenAI for trade secret theft, alleging the AI giant deliberately and systematically solicited and stole confidential information from the iPhone maker’s current and former employees. The complaint is 41 pages long and reads less like a dry legal document and more like a corporate spy thriller.

The filing says that there are over 400 former Apple employees now working at OpenAI. Apple uses that number to argue that the flow of people also meant a flow of its most sensitive secrets. Apple accused two former employees now working at OpenAI of systematically stealing confidential data, including information about unreleased hardware products, technical specifications, and details about vendors and contractors in Apple’s supply chain.

The Two Named Defendants

Tang Tan, also mentioned in the complaint, is an Apple veteran who worked on iPhone and Apple Watch and now serves as OpenAI’s chief hardware officer. Tang co-founded io Products as the dedicated hardware vehicle for OpenAI.

Chang Liu, meanwhile, worked at Apple for eight years and was a senior system electrical engineer before departing to join OpenAI in January 2026. The lawsuit claims that while Liu was developing hardware for OpenAI, he accessed and downloaded dozens of confidential files from Apple’s network, many labelled as confidential.

But Liu’s behaviour was not just about downloading files. After he left, the lawsuit alleges that Liu kept in contact with Yu-Ting ‘Alyssa’ Peng, who was still employed at Apple. About four months later, Peng also joined OpenAI. But before she left, Peng continued to have in-depth conversations with Liu about confidential Apple projects, Apple alleges.

The ‘Dreaded Walkout’ Coaching Tactic

One of the most explosive parts of the filing is the claim that OpenAI actively coached departing Apple workers on how to avoid getting caught. Apple alleges that OpenAI coached departing Apple employees on how to evade Apple’s security procedures to reduce the chance their alleged trade secret theft would be caught. The complaint claims that OpenAI circulated an internal Apple document bearing a ‘Need to know’ designation to new hires with details on how to avoid the ‘dreaded walkout,’ which would immediately remove them from Apple after giving notice, instead of letting them continue to work for the typical two weeks.

OpenAI also ‘counseled departing employees not to disclose their next employer and given advice on how to avoid the dreaded walk out that would promptly remove them from the company rather than giving them a standard two weeks in which they could continue to access Apple’s confidential information and trade secrets,’ according to the suit.

Jony Ive and the io Products Angle

The most famous name hovering over this case is Jony Ive, Apple’s legendary former chief design officer. The most famous ex-Apple employee now at OpenAI, Jony Ive, is not named in the case, though his involvement is implied as the co-founder of io, an AI hardware startup OpenAI purchased in 2025 and that Apple is now suing as part of the case.

OpenAI acquired Ive’s startup io as part of a $6.5 billion deal last year. OpenAI’s takeover of the company included more than 50 engineers, developers, and other employees.

Apple is seeking a court injunction that would prevent OpenAI from possessing, using, or sharing any of Apple’s trade secrets. Additionally, Apple wants a court order requiring OpenAI to return all confidential materials and compensate Apple for damages.

Apple said it attempted to resolve the OpenAI dispute out of court months ago, asking it to cease the efforts and eliminate any proprietary materials. It said that it did not receive a response, leading Apple to file the lawsuit.

For its part, OpenAI is pushing back. OpenAI says it has ‘no interest in other companies’ trade secrets,’ and that it is still reviewing the lawsuit.
