The Federal Tax Ombudsman (FTO) has advised the Federal Board of Revenue (FBR) to instruct Pak Suzuki Motor Company (PSMC) to pay KIBOR + 3 percent annually against late deliveries of automobiles that exceed 60 days after the initial booking.
The Regional Tax Office (RTO) and PSMC were the targets of a complaint made by a consumer, according to the specifics. The complainant claimed that PSMC’s authorized dealer delayed delivery of his vehicle by more than five and a half months, exceeding the allowed window of 60 days.
On automobiles with engines larger than 850cc, the government increased the rates of sales tax and federal excise duty to 17% and 2.5%, respectively, during the waiting period.
Following the increase in tax rates, the corporation taxed the complaint at the new rates. The extra money should be returned to the complainant, according to FTO, and PSMC should be punished for its behavior.
The customer declaration on behalf of the complaint is included in the provisional booking order that Suzuki Islamabad Motors issued to the complainant, according to the complainant’s associate representative during the hearing. The customer declaration reads as follows:
“I hereby declare that I have read and understood all terms and conditions contained on the reverse side of this provisional booking form and accept the same in total without any reservation and undertake to abide by the same and amendment thereby.”
The complainant claimed that the extra financial burden caused by the delayed delivery, which the carmaker is liable for, had caused him great emotional and financial distress.
He also drew attention to the Customs Notice SRO 656(I)/2006 and its amending notification SRO 837(I)/2021 issued by the Revenue Division, which notify that
“The importer-cum-assembler or Original Equipment Manufacturers (OEM) shall pay KIBOR plus 3 percent per annum to the customer against delayed delivery exceeding 60-days of initial booking.”
The FTO’s ruling further said that PSMC is obligated and responsible to reimburse the Complainant KIBOR +3% per year against late deliveries that occur more than 60 days from the first booking on the entire deposited sum.
